Judge orders ex-Penn State president Graham Spanier to begin prison sentence July 9 by Pittsburgh Post-Gazette, May 26, 2021
A judge on Wednesday ordered Graham Spanier, the former Penn State University president, to begin serving a sentence on a misdemeanor child endangerment conviction.
Mr. Spanier, 72, will begin serving his sentence — a minimum of two months in jail, followed by two months of house arrest — on July 9. He enables life-long suffering to the student harmed, and gets a measily few months? How many others? His privileged white maleness will likely get his term reduced to a picnic in jail. Frac! May he and all like him, rot eternally in penile itch and misery. At mininum, this heinous enabler needs to have his pension taken, and given to the harmed.
He had been found guilty by a Dauphin County jury in March 2017 of a single misdemeanor count of endangering the welfare of children by the way he responded to a 2001 complaint that Jerry Sandusky had attacked a boy in a Nittany Lions football team shower that year.
Mr. Spanier had avoided prison thus far because of a series of appeals that, at one point, saw his conviction overturned, but later reinstated by the 3rd U.S. Circuit Court of Appeals in December.
The latest ruling was handed down by Judge John Boccabella, a visiting senior judge from Berks County.
Mr. Spanier was forced out as university president shortly after Sandusky’s 2011 arrest on child molestation charges. A year later, Mr. Spanier was himself accused of a criminal cover-up, although many of those counts were later thrown out.
Mr. Spanier has said the abuse of the boy, who has not been conclusively identified by authorities, was characterized as horseplay. The incident was not reported to authorities after Mr. Spanier wrote in an email to aides that “the only downside for us is if the message isn’t ‘heard’ and acted upon, and we then become vulnerable for not having reported it.”
Mr. Spanier, who did not testify in his own defense, told Judge Boccabella at sentencing that he regretted not intervening more forcefully.
“Today marks the end of a long road towards justice for the children endangered by Mr. Spanier’s inaction — choosing to cover up the abuse at the hands of Jerry Sandusky rather than reporting it to law enforcement,” said state Attorney General Josh Shapiro in a statement. “No one is above the law Except in Caveman Canada, of course, where lying judges and lying quitting rule-breaking lawyers and lying crime-enabling authorities (including AER/CER/OGC/RCMP/police/CSIS etc) abound – teaching frac, oil and gas companies it’s fine to break the law, and easy to get away with because only the harmed will be punished, other than a few rare cases to make the public believe in Canada’s fake rule of law, and my office will continue to pursue anyone who looks the other way in the face of child sexual abuse. There are consequences for failing to protect children in Pennsylvania.”
On Wednesday, Mr. Spanier’s attorneys sought modification that would allow their client to escape prison time. They had asked that Mr. Spanier be put on house arrest with electronic monitoring. Prosecutors, meanwhile, told the judge they would support work release with medical furloughs.
Mr. Spanier had heart surgery in 2019 and has an advanced stage of prostate cancer, according to his lawyers.
