A former Alberta justice minister is taking legal action after the province’s human rights commission shot down attempts to anonymize his unsuccessful discrimination complaint against a high-end jewelry store.
Jonathan Denis claims he was discriminated against when he was asked to leave a Tiffany & Co. store in Calgary in 2022 for not wearing a mask. The ex-Progressive Conservative MLA told staff at the store he was medically exempt from masking due to asthma.

The Alberta Human Rights Tribunal ultimately sided with Tiffany, finding the company took reasonable steps to accommodate patrons who could not wear masks for medical reasons during the COVID-19 pandemic.
It later dismissed Denis’s attempt to anonymize his name and suspend publication of the decision pending an appeal, on the grounds that publicizing the case would violate his privacy.

In an email Monday, Denis’s firm, Guardian Law Group, maintained Tiffany’s practices are discriminatory and criticized the human rights commission’s handling of the case.
“After a four-year delay, the commission refused to even investigate the matter — despite our client being fully vaccinated and other similar cases which have found such practices to be discriminatory,” the email states.

Requests for anonymization, publication restrictions denied

Denis visited a Calgary Tiffany’s store on Jan. 30, 2022, to view items that were not available online. He told the tribunal that when asked to wear a mask, he provided staff with his medical exemption. A manager eventually became involved and asked Denis to leave the store.
Denis filed a complaint in 2023, arguing his treatment violated Section 4 of the Alberta Human Rights Act. That section prohibits discrimination in the provision of goods and services on the basis of a variety of protected categories, including people with physical disabilities.

The Alberta Human Rights Tribunal disagreed, finding the masking rules Tiffany imposed in response to public health orders did not create an “undue hardship.” Specifically, the tribunal found the jeweller’s online and virtual shopping options, alongside with curb-side pickup, were reasonable accommodations for people who could not wear masks for medical reasons.

That decision was upheld in January after Denis requested a formal review.
“The tribunal has consistently held that the duty to accommodate does not require a service provider to permit in-person access where reasonable alternatives exist, particularly in the context of COVID-19 public health measures,” human rights commission member Malik Hattum wrote.
“The complainant’s (Denis) materials do not identify any evidence that the alternative accommodation measures relied upon by the respondent (Tiffany & Co.) were inaccessible to him, discriminatory in their effect, or insufficient to meet the respondent’s obligations under the act.”
In subsequent decisions, the tribunal also shot down Denis’s attempts to anonymize the decision or delay its publication. Hattum said that anyone seeking to anonymize a decision or restrict its release must prove their privacy outweighs the public interest in open proceedings
“Beyond a general reference to privacy and safety in the context of the COVID-19 pandemic, the complainant has not explained how publication of his name would result in harm that differs in nature or degree from that experienced by other complainants whose matters are decided publicly.”
The tribunal also disputed Denis’s claim that information about asthma constituted sensitive medical information, or that he might not have proceeded with a review had he known it might be published under his name.

The tribunal’s most recent decision in the case, published March 9, dismissed Denis’s request for reconsideration of the decisions on anonymization and publication. Hattum said the application was largely a reiteration of Denis’s earlier arguments.
