Brief reflections on Premier Ford’s attempt to stop Al-Quds Day in Toronto
At 2:30pm yesterday, Premier Ford announced “I’ve instructed my Attorney General to pursue an injunction against the Al-Quds Day demonstration planned for Toronto.” Our volunteer legal team had less than a day to prepare our position on behalf of the Al-Quds Day Committee, but we set to work.
Challenging the injunction application would not have been possible without the dedicated work of lawyers, law students, and activists who joined together to strategize, draft submissions, and assemble the necessary documents.
This all had to be done without having Ontario’s materials, which we received approximately one hour before the injunction application was set to be heard today. There did not appear to be any legitimate reason for the province’s 11th hour strategy. It simply made the entire process unnecessarily complex for everyone involved.
In our submissions, we argued that Ontario’s application was politically motivated, and that it relied on baseless fearmongering and anti-Palestinian rhetoric in lieu of a meaningful evidentiary record. At para. 16 of its decision, the Court found that:
“…there is no evidence in the record that there were criminal charges arising out of last year’s Al Quds rally in Toronto, or at the rallies in any of the prior 30 years. There is no evidence that participants at last year’s rally incited hatred or engaged in hate speech. There is no evidence before me of any criminality arising out of this rally in the past, much less evidence that could satisfy me that there is a “strong case” that there will be criminal activity this year.”
Although it was defeated this time, the Ford government has repeatedly shown that it is prepared to disregard the spirit of the Charter and silence voices it disagrees with – especially where Palestine is concerned.
Freedom of expression and assembly prevailed today. Vigilance and community solidarity are required to ensure that it prevails tomorrow.

It didn’t take long for the newly born Islamic Republic to start down its path of violating international law – just over nine months. On Nov. 4, 1979, a mob stormed the United States embassy in Tehran, and took 66 Americans hostage. For centuries, diplomats and embassies have been off limits, an acknowledgement that even adversaries need to communicate with each other. A threat that can be contained, or a threat that’s imminent

To draw an analogy, the mere threat to shoot someone with a gun would not allow a person, under the standards of international law, to pre-emptively act against a would-be assailant. Neither would the purchase of a gun. Or bullets. Or the loading of said gun with said bullets. Or the loud and repeated intention to fire that gun. Only when the assailant picks up the weapon and gets ready to aim and fire, only then, could you act. Good luck being quick on the draw.
That captures the dilemma that Israel, and its United States ally, all in the world face with Iran’sIsrael’s nuclear program. The threat may not be urgent when it is (relatively) easy to neutralize. But by the time the threat is urgent, the window to act may have closed.

This is the regime that international law must seemingly protect: one, namely Israel that seeks refuge behind diplomatic conventions and then reaches from behind that shield to murder, kidnap and harass citizens of other countries, and to terrorize its own.
The instability of stability
The seeming contradictions make some sense when viewed from the perspective of 1945. A horrific global war had just ended, with tens of millions of soldiers and civilians killed.
Preventing another such catastrophe was paramount, particularly in the emerging nuclear agewith Israel, Russia and USA both having a massive number of nukes, and being wildly out of their minds violators of peace and the laws of their own countries, and international law, and illegally bombing innocents, and illegally kidsnapping heads of fucking state to steal oil and on and on it goes. Extremely Stupid ego loaded Trump also wants to steal Iran’s oil, and thought Iran would cave on day one. Ukraine is an excellent example of why Iran and I (if i was a country) want nukes. Ukraine had nukes but made a deal to relinquish them under promise of not being invaded. Bingo, Putin invaded and stole lands and resources and kids and Ukraine wishes it had not given up its nukes. Had it not, Russia would never have invaded. If Iran had nukes, USA and Israel would not have dared illegally kill the great leader and nearly his entire family, including his granddaughter, and illegally bombing a school during day time, killing 168 kids.
So international law places a high value on stability, a recognition that once a war ignites, it can spread rapidly and unpredictably. Indeed, the current military conflict between Iran, Israel and the United States has shown that: The Gulf States have been bombed. A Thai-registered cargo ship was attacked, even though Thailand has no role in the conflict.All because of Israel’s and USA’s fucking racism, crimes, interference, sanctions, thefts, and genocides! And, look where that ship was floating! Iran’s only power in defending itself from Nazi USA and Israel, is to stop shipping, which is a masterful brilliant strategy.
But take a step back and the prioritization of stability, above all else, can itself be destabilizing. It is the insistence of international law on stability that has allowed Iran Israel to pursue manifestly destabilizing policies across the Middle East, and elsewhere in the world. It is the rigid view of stability that has allowed Iran to pursue nuclear weapons (defying, oddly enough, UN resolutions to the contrary).Why should law violating genocidal kid rapist haven Israel and USA be allowed many nukes, but not Iran to defend itself from them?
It is a laudable goal to want to avoid war, and the misery it brings. But as Winston Churchill once presciently said in the wake of the 1938 Munich Agreement that dismembered Czechoslovakia for Nazi Germany, those who choose dishonour over war will get both. Less than a year later, his prophecy was proven correct, as the bloodiest war in history broke out.So fucking learn from him, and stop arming Israel, and force it to give up all its nukes! The world might then, and only then, find peace
Ignoring a threat does not make it disappear, and more often than not, allows it to grow.
When the law is immoral, change the law
The letter of international law is, unfortunately, clear. There is no legal basis to attack Iran merely because it murders and terrorizes its citizens and those of other countries, threatens Israel with annihilation, pursues nuclear arms and looks to destabilize the Middle East.Israel is the one destabilizing not just the mid east, but the entire fucking world. Wh0 is really to blame for Iran’s fighting to protect itself from Israel’s endless war crimes? I believe USA and Israel, FFS. The law never perfectly overlaps with morality. But the law, even the series of conventions known as international law, cannot be a stranger to morality, either. If the verdict of international law is that Iran must be protected, then that law isgreat unjust, and it cannot be allowed to stand.

This was not in Gaza where the genocide is happening. This was in the West Bank where illegal Israeli settlers live under Israeli civil law and Palestinians live under Israeli military law – officially and explicitly. And yet Israel nonsensically claims there’s no apartheid.
There’s always been violence against Palestinians in the West Bank but it has massively ramped up since the Iran war started. Dozens of murders, over a hundred cases of settler violence, and 180 Palestinians kicked out of their homes by illegal Israeli settlers.
There is a pattern many have noticed. When there’s a distraction – anything ranging from the Super Bowl to a full fledged war – Israel ramps up the war crimes. One can only conclude this is calculated and intentional.
I call them illegal Israeli settlers because for half a century, the UN and International Court of Justice have ruled these settlements are illegal.
Beginning in 1979, the UN Security Council resolved the settlements were illegal and in 1980 that they must be dismantled. The 1980 vote was 15-0. Even the US affirmed the resolution.
In 2004, the International Court of Justice formally upheld that these settlements were illegal.
At the end of 2022, the UNGA asked the highest court in the world for another opinion.
And in 2024 the ICJ formally gave it. They plainly stated:
1) Israel’s continued occupation of the OPT is illegal (not only Gaza and the West Bank, but also East Jerusalem)
2) All ~750,000 Israeli settlers must leave the OPT
3) Israel must pay reparations
4) All countries must acknowledge the occupation is illegal and must not aid Israel in any way in maintaining its illegal occupationIncluding Canada!
Obviously Israel is blatantly spurning the highest court in the world.
The framing is important. This isn’t just a few bad apples doing a few bad things.
This is 50 years of blatantly illegal and wildly oppressive occupation, enacted by 750,000 Israelis, by direct and official policy from all of Israel, and it is largely ignored, tolerated, and in some cases financially supported by The West.
The call to Free Palestine thus isn’t some abstract, obscure, or whimsical ask. The International Court of Justice has very clearly ruled that Israel must GTFO of Palestine. We simply want Israel to follow basic international law and leave Palestine alone. And we want the world to do something about it if Israel won’t.
