Now that Trump is threatening genocide–for that is what “a whole civilization will die” means–do states have a legal duty to stop him, including by lethal force if necessary? I think the answer to this is “Yes” and it needs to be discussed rationally.
The Genocide Convention makes it a duty of all states (whether they signed it or not) to prevent genocide. In the past, that duty has been interpreted to justify lethal force. Even America itself invoked it in Kosovo.
But Trump has not resorted to genocide yet. Lethal force is therefore uncalled for–but discussing it is timely, because he might cross that line as soon as tonight, he says. Which would make it timely, if carried out lawfully.
When can it be lawful? Two answers:
- When he issues an order to commit genocide. If the military refused his order and used deadly force against him as an act of necessity, I think that would be lawful.
- If the genocidal act actually happens. At that point, any state may use force against him.
We need a rational discussion, starting now, of these options. Such a discussion has been had about Putin, al-Bashir, and Netanyahu, among others. Time to have the same about Trump.
What if we do not have that discussion?
Then we have a madman capable of nuclear annihilation, openly threatening genocide. Not even Putin has done that.
Trump is already past the point where Putin won’t go.
Today is the day all American allies need to pull all cooperation with this war.
But do not take my word for it. This is what the US Government itself said in its Genocide Prevention Task Force, and simply put, America’s stated that it is lawful to use force to prevent genocide, even without Security Council approval:
