Authors are celebrating a “historic” settlement expected to be reached soon in a class-action lawsuit over Anthropic’s AI training data.
On Tuesday, US District Judge William Alsup confirmed that Anthropic and the authors “believe they have a settlement in principle” and will file a motion for preliminary approval of the settlement by September 5.
The settlement announcement comes after Alsup certified what AI industry advocates criticized as the largest copyright class action of all time. Although the lawsuit was raised by three authors—Andrea Bartz, Kirk Wallace Johnson, and Charles Graeber—Alsup allowed up to 7 million claimants to join based on the large number of books that Anthropic may have illegally downloaded to train its AI models.
If every author in the class filed a claim, industry advocates warned, it would “financially ruin” the entire AI industry.It needs to be ruined, same as the tech bros creating vile Nazi misogynistic super stupid mistake ridden STOLEN AI.
It’s unclear if the class certification prompted the settlement or what terms authors agreed to, but according to court filings, the settlement terms are binding. A lawyer representing authors, Justin A. Nelson, told Ars that more details would be revealed soon, and he confirmed that the suing authors are claiming a win for possibly millions of class members.
“This historic settlement will benefit all class members,” Nelson said. “We look forward to announcing details of the settlement in the coming weeks.”
Ars could not immediately reach Anthropic for comment, but Anthropic had previously argued that the lawsuit could doom the emerging company, which was started by former OpenAI employees in 2021.
It seems likely that facing “hundreds of billions of dollars in potential damages liability at trial in four months” pushed the company to settle—particularly since industry advocates noted that one risk of Alsup certifying such a large class action is that it paved the way for any AI company to simply fold when facing such substantial damages, regardless of the merits of their case.
Wired estimated that damages could have gone even higher, with Anthropic potentially risking “more than $1 trillion in damages.”
Alsup had previously ruled that Anthropic’s training on authors’ works was “fair use,” so the settlement likely won’t obscure the answers to any big emerging copyright questions still swirling in the AI industry. Advocates had warned that the possibility may be the outcome of the surprising class certification, setting a precedent.
Apparently, Anthropic’s decision to settle came as the AI company was struggling with its legal strategy. Edward Lee, an AI copyright expert and law professor at Santa Clara University, told Wired that the settlement is “a stunning turn of events, given how Anthropic was fighting tooth and nail in two courts in this case. And the company recently hired a new trial team.”
But perhaps Anthropic’s pivot to bringing in new legal expertise came too late, or the legal team saw the writing on the wall. Lee noted that the company “had few defenses at trial, given how Judge Alsup ruled. So Anthropic was starting at the risk of statutory damages in ‘doomsday’ amounts.”

When recently asked to namecheck a few Canadian firms putting AI to cool uses, you mentioned Vancouver’s GlüxKind. They’re developing a self-driving baby carriage. I have mixed feelings about that!
I met the GlüxKind guys in Paris at VivaTech, the largest startup and tech conference in Europe. Canada was country of the year, and about 170 of our companies were there. Emmanuel Macron comes in—it’s mayhem, right? Four days, 180,000 people. It felt like a rock concert, like when I was back at Shift magazine doing internet conferences 20 years ago. Every booth had another idea: AI that maps malls, robotics, crazy things. Among them was the baby carriage. It has sensors that read where traffic is if you don’t want to push it—the Europeans love it.
Sounds about right.
I know it’s like, “Do I need an AI-powered baby carriage?” But I remember when my dad was alive and automatic car starters came out. He was like, “Oh, you’re too lazy to turn a key?” In the winter? Who doesn’t want those now?ya, and look at how many vehicles are stolen every day in Canada. Fucking idiots want babies to get stolen too? With ATMs, Dad said, “Am I really going to put my money into the wall?” And then, “Am I really buying things by putting my credit card information on the internet?” Yes! AI is just a tool. If you’re a working carpenter and one day I said, “You can cut that with this electric saw much quicker,” and you said, “I prefer the handsaw!”… Okay!
A big priority of yours is getting the private sector on board with AI. This year, BenchSci, a biomedical tech company in Toronto, laid off almost a quarter of its workforce because it found AI efficiencies. One “problem” companies seem to be solving with AI is paying wages. How are you planning to protect the average Canadian worker amid all the excitement around private profit?
I’m glad you raised that, but we’ve got to be careful about not just fighting the last war. Of course you’re going to see moments where tech is used instead of workers, but mostly what you see is new opportunities.
There are companies with valuations of over $1 billion in lofts in downtown Toronto—and you’ve never heard of them. It’s a real buccaneer’s moment, of people betting the farm. We can tell that story, as opposed to “something new’s here, and it’s a eulogy, not a celebration.”
I understand, but tech can generally be implemented faster than people can be upskilled. Nick Frosst, Cohere’s co-founder, worries AI could create more precarious jobs and worsen income inequality. First of all, let’s be careful. There’s no consensus that AI is going to displace mass numbers of jobs.
But it will, right? No matter which research you look at, something like half of all jobs are now at least disruptable by AI. It will.

Look at health care: Reveal Surgical, a Canadian company, developed an AI-powered detection system that can help surgeons identify cancerous tissue in real-time.And, is already making surgeons dumber and dumber.

Everyone’s asking: how do we combat the loneliness epidemic? Social circles matter, and you’re lucky if you have a partner and kids and friends. A lot of people don’t. I had elderly family members whose only companion was a TV. I’ve met constituents whose lights were all off to save electricity but who left the TV on for the same reason. If you had something to carry on a conversation with—and not just watch—that might be better. But there was also that Joaquin Phoenix movie, Her, where he was in love with an AI. Of course we have to be vigilant.
With two university-aged kids, you’re clearly past the “should we just give them the iPad” issue. How do you talk to them about balancing the AI world with the real one?
Luckily, my kids haven’t had a massive screen-to-nature imbalance. My son was a guide at canoe camp, and my daughter was a tree-planter. (So was I, actually.) I’ve told them to try to get comfortable with AI, so they’re not swayed by three articles. Think about the billions of dollars and hours teachers have spent trying to make sure every kid can read and use a pen to scribble the alphabet. Spelling may be less important now because of spellcheck, but there are still going to be new things to learn.

Thiel is the billionaire owner and founder of Palantir, the world’s largest private surveillance company, one of the biggest financiers of OpenAI and one of Silicon Valley’s most influential ideologues. Douthat asked Thiel, “You would prefer the human race to endure, right?” After hesitating, Thiel replied, “I don’t know.” A glimpse of the impact of his response and the journalist’s astonishment led him to amend his statement: “I, I would prefer, I would prefer.” Would he, though?
Thiel is one of the main promoters of the archaic ideology that dominates the thinking of men such as Elon Musk, Jeff Bezos, Mark Zuckerberg, Tim Cook, Sundar Pichai, Andreessen Horowitz, Sam Altman, and Bill Gates.
Although these tech moguls are presented as neutral or technology driven, reality is different. Their adaptation to the far-right is no longer surprising. To destroy democracy, they advocate dismantling the institutional apparatus of nation states, not because of any oppression or inequality, but to ensure that injustices have no social opposition and that, if opposition does arise, it can be strongly repressed. They advocate the removal of almost all public officials and services, increasing the numbers of the armed forces and police, building up the capacity for repression by the powers that be, no longer public, but corporate and business.

The science fiction in the minds of these billionaires, articulated with the orphaned leaders of the new fascist movements on the rise, has concrete and material effects.
They are producing, in addition to suffering on a massive scale, a catastrophic waste of time and resources in the face of the greatest crisis in human history, the climate crisis. The techlords intend to bring humanity to the brink of collapse and then, in a magic trick, rise to power, saving the species or themselves as the last specimens.
