Bill C9, now in force as the Combatting Hate Act, was ostensibly created to protect marginalized populations targeted by hate crimes. However, many such groups representing these populations opposed the bill from the start, predicting that it would criminalize dissent rather than contribute to the safety of their communities. The Legal Centre for Palestine, Independent Jewish Voices, and the Centre for Free Expression are deeply concerned that this law will be wielded against Palestinians and solidarity advocates, as well as Indigenous and racialized communities already facing overpolicing, repression, and discrimination when exercising their rights.
It is in this climate that we revisit the Combatting Hate Act, starting off with a technical discussion of the law and what the implications on free expression and protest may be as we wait to see the law enforced on the ground.
The event will then move to a panel discussion on the notion of safety that the law attempts to articulate, in the context of recent developments such as the extensive use of hate crime charges in Toronto on activists, a rash of Islamophobic attacks, and a Government–commissioned report on antisemitism on university campuses.

Thanks so much for this informative and important discussion about bill c-9. It’s really important that people know about this new legislation and I don’t think it’s being talked about enough. Just a small but important correction – Professor Bhabha mentions at 18:28 the consent of the Attorney General is no longer required in order to pursue hate crime charges – while this was part of the original draft of the bill it was eventually left out due to opposition, and the bill that is now in effect still requires the consent of the Attorney General to proceed with charges. It does seem true that police will have discretion whether or not to arrest someone for a hate crime, but the attorney general would still have to approve the case before it went to court, if I understand correctly. Larry Haiven mentions this later but I just wanted to make that clear in case people didn’t make it to the 45 minute mark. Thanks again for this great discussion!
