Foster’s description of the sludge doesn’t match what the state Department of Environmental Protection found in its investigation of the dumping. “‘Frack mud’ as described by the defendant does not exist,” said Dan Spadoni, a DEP spokesman, after this newspaper contacted him about the plea. “The material was sludge from oil-based drilling mud,” Spadoni said. “It was generated from cleaning out tanks used to store the mud during the drilling process.”
