THE United States has responded to allegations that it “abducted” two people from Scotland despite a court order that they were not to leave the jurisdiction.
It comes after Scotland’s Justice Secretary Angela Constance suggested there had been a lack of “respect” for Scots law shown in the handling of the case of the Russian-flagged oil tanker Marinera.
Seized by the US on January 7, the tanker was then escorted into Scottish waters and its crew of 28 people detained – without the Scottish Government being made aware.
On Monday – at the request of Natia Dzadzama, the wife of the vessel’s captain Avtandil Kalandadzeship – the Court of Session issued an interim interdict prohibiting both Kalandadzeship and his unnamed first officer’s removal from the territorial jurisdiction of Scotland.
However, the order was recalled on Tuesday after the court was told that the US Department Justice had emailed Scotland’s prosecution service at 03:04am to confirm the captain and first officer had been taken off the Marinera on to the US Coastguard ship Munro .
Aamer Anwar, the lawyer acting for Dzadzama said the US had “no lawful authority to arrest or detain individuals within Scotland”. He alleged that the pair had been “whisked away under the cover of darkness [and] we have no idea what role our own governments played in that”.
Scottish Green co-leader Ross Greer said: “It very much looks like the US Government has just abducted two people from Scotland hours after our Court of Session ordered that they not be removed.” …
